Terms of Service

These Terms of Service (the “Terms”) are an agreement between Race Hawks (“Race Hawks,” “we,” “us,” or “our”) and you, the person who accesses or creates an account on racehawks.com (“you”). They govern your use of the Race Hawks website, web app, and any related tools and downloads (together, the “Service”).

Race Hawks is engineered on a modern, cloud-native, serverless architecture with enterprise-grade reliability, end-to-end encryption in transit (TLS 1.2+) and at rest (AES-256), least-privilege role-based access controls, continuous monitoring, and defense-in-depth safeguards. We process personal data in alignment with the principles of the EU General Data Protection Regulation (GDPR), the UK GDPR, and the California Consumer Privacy Act as amended by the CPRA (collectively, “CCPA”), and we maintain a documented sub-processor register and standard contractual clauses (SCCs) for cross-border transfers, all as further described in our Privacy Policy. By accessing the Service, you acknowledge these practices and consent to the processing, storage, and transfer of your data on this basis.

1. Acceptance of these Terms

By creating an account, checking a box that links to these Terms, or otherwise accessing or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service. If you are using Race Hawks on behalf of a team or organization, you represent that you have authority to accept these Terms for it.

2. Eligibility and accounts

You must be at least 13 years old to create an account, and old enough to form a binding contract in your jurisdiction, or have a parent or guardian’s permission. You are responsible for the accuracy of your account information, for keeping your password secure, and for all activity under your account. You may sign in with an email and password or with Google. When you sign in you set a public username, and you may add a profile picture; both must be appropriate, must not be offensive, and must not impersonate anyone. We may reclaim or reset usernames and remove profile pictures that break these Terms. Notify us promptly of any unauthorized use of your account.

2a. Emails you agree to receive

By creating an account or signing in to Race Hawks, you agree that we may email you at the address on your account. That includes required transactional emails (verification, password resets, account and security notices) and occasional product emails such as new features, new courses, and race-prep tips. You can opt out of the non-essential product emails at any time using the unsubscribe link in those emails or by emailing us at the address in our Privacy Policy; required transactional emails will still be sent while your account is active.

3. What Race Hawks is

Race Hawks shows pre-recorded aerial flyover videos of race courses, along with elevation profiles, course distance and elevation figures, a race pacing tool, and downloadable pacing and course sheets. Everything on Race Hawks is for general planning and entertainment. Distances, elevations, grades, paces, and course lines are estimates, may contain errors, may be out of date, and are not official race documents.

4. Not race-day guidance or safety advice

Course layouts change, and race organizers set the official route on race day. Always follow the directions of race officials, posted signage, and course marshals. Running and racing carry inherent physical risks. You are responsible for your own safety and for deciding whether a course, route, or pacing plan is appropriate for you. Race Hawks is not a substitute for official course information or for medical, coaching, or safety advice.

5. How the content is produced

The flyover videos and course visuals are produced using Google Maps Platform and Cesium Ion. That imagery and data belong to their respective providers and are subject to their terms.

6. No redistribution of the flyovers or visuals

The flyover videos, course preview images, and elevation profiles are provided for viewing on Race Hawks only. You may not download, copy, screen-record, re-upload, re-host, embed, broadcast, sell, or otherwise redistribute or reproduce them, in whole or in part, anywhere off Race Hawks, for any purpose.

7. Downloadable pacing and course sheets

Race Hawks lets you generate and download PDF pacing plans and course sheets for your own personal, non-commercial use. You may not republish, redistribute, sell, or share those PDFs, and you may not extract the underlying videos or imagery from them.

8. Acceptable use

You agree not to: (a) scrape, crawl, or bulk-download the Service or its content; (b) extract, re-host, or redistribute the flyover videos, images, or elevation data; (c) resell or commercially exploit the Service without written permission; or (d) attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its servers.

8a. Community guidelines and user content

Signed-in runners can post comments and tips on course pages and like other runners’ posts (“user content”). You are responsible for what you post. By posting, you grant Race Hawks a non-exclusive, royalty-free, worldwide license to store, display, and distribute that content on the Service; you keep ownership of it.

To keep the community useful and kind, you agree not to post content that: harasses, bullies, demeans, or is cruel to other runners; is hateful, threatening, or discriminatory; is sexual, obscene, or violent; impersonates anyone; is spam, advertising, or self-promotion (including links to your own channels, products, or content); or is false, misleading, or off-topic. Usernames and profile pictures are subject to the same rules.

We may review, moderate, hide, remove, or refuse any user content. We use automated tools, including AI-based content flagging, together with human review to detect content that may break these rules; content flagged as high-risk may be held or removed before or after it appears. We may warn, suspend, or permanently ban accounts that post inappropriate content, use inappropriate usernames or language, are cruel to other runners, or repeatedly break these rules, at our discretion. Nothing here obligates us to monitor all content.

You can reply to other runners’ comments, and you can edit or delete your own comment within one hour of posting it or of your last edit; after that window it stays as posted. Deleting a comment also removes its replies. If you delete your account, your comments are kept but anonymized (your name and profile picture are removed and your likes are cleared), so course knowledge shared with the community is not lost.

9. Ownership and feedback

Except for the third-party imagery and data described above, the design, text, graphics, videos, and generated visuals on Race Hawks are owned by Race Hawks. No license to reuse, redistribute, or create derivative works is granted except as expressly stated. If you send us feedback or ideas, you grant us a royalty-free right to use them without obligation to you.

10. No warranty

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any course data or estimate is complete or correct.

11. Limitation of liability

To the fullest extent permitted by law, Race Hawks and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service or reliance on its content, including any injury or loss connected to running a course. Where liability cannot be excluded, our total liability is limited to US$50.

12. Indemnification

You agree to indemnify and hold Race Hawks harmless from claims, losses, and expenses arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party right.

13. Suspension and termination

We may suspend or terminate your access if you breach these Terms or misuse the Service. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnification, and governing law) will survive.

14. Changes to the Service and these Terms

We may change, suspend, or discontinue any part of the Service at any time, and may update these Terms. When the Terms change, the “Last updated” date above will be revised, and for material changes we will provide reasonable notice. Continued use after changes take effect means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. To the fullest extent permitted by applicable law, you and Race Hawks agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through final and binding individual arbitration administered under the applicable commercial arbitration rules, rather than in court, and you and Race Hawks each waive any right to a jury trial and to participate in a class, collective, consolidated, or representative action (the “class-action waiver”). Nothing in this section limits either party’s right to seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual-property rights. Where arbitration is unavailable, the exclusive venue is the state or federal courts located in California, and you consent to their personal jurisdiction.

15a. Compliance, data protection, and security

Race Hawks maintains a security program built on defense-in-depth, least-privilege access, encryption in transit and at rest, continuous logging and monitoring, and periodic review of its controls. Our processing of personal data is aligned with the principles of the GDPR, the UK GDPR, and the CCPA/CPRA; international transfers are governed by standard contractual clauses (SCCs) or an equivalent lawful transfer mechanism; and our current sub-processors are handled under written data-processing terms. You agree to use the Service in compliance with all applicable laws, including export-control, sanctions, anti-spam, and data-protection regulations, and not to use it in any embargoed jurisdiction or in violation of any applicable acceptable-use or anti-abuse requirement.

16. Copyright and DMCA notices

If you believe content on Race Hawks infringes your copyright, send a notice to info@racehawks.com identifying the work claimed to be infringed, the material you claim is infringing and its location on the Service, your contact information, a statement that you have a good-faith belief the use is unauthorized, and a statement under penalty of perjury that the notice is accurate and that you are authorized to act. We will respond in accordance with the Digital Millennium Copyright Act.

17. Severability

If any provision of these Terms is found unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire agreement

These Terms, together with the Privacy Policy, are the entire agreement between you and Race Hawks regarding the Service, and supersede any prior agreements on the same subject.

19. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

20. Force majeure

We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disaster, war, terrorism, riots, labor conditions, governmental action, and internet, hosting, or third-party service disruptions.
